These terms are the agreement between you and us. The most important thing in them is section 3: we are a place to publish and be found, not a marketplace that handles your money.
1 Who we are and who may use the service
BoothPost is an online platform at boothpost.vlastevski.com where businesses and individuals create a profile, publish posts and articles, list products and services, and are discovered by customers.
You must be at least 16 years old to create an account. Both individuals and businesses may register. If you register on behalf of a business, you confirm that you are authorised to act for it.
By creating an account you agree to these terms. If you do not agree with them, do not use the service.
2 What the platform does
With an account you can:
- · create a personal or business profile
- · publish posts, images, polls and events
- · write and publish articles
- · list products, with prices and photographs
- · list services, with prices and availability
- · receive orders and booking requests from customers
- · message other users and reply to comments and reviews
- · follow businesses and save what they publish
- · subscribe to a paid plan for higher limits and additional features
We provide the software, the hosting and the audience. What you publish, and what you agree with the people who contact you through it, is yours.
3 We are not a marketplace and we do not handle your money
Read this section carefully. It defines the limit of our role.
The only payment that passes through us is your subscription payment to us. Nothing else does. Specifically:
- We do not process payments between users.
- We do not collect money on anyone's behalf.
- We are not an escrow service and we never hold user funds.
- We are not the seller of any product listed here.
- We are not the provider of any service listed here.
- We are not the buyer of anything listed here.
- We are not an agent for either side of a transaction.
- We do not guarantee that a transaction will happen, or that it will go well.
- We do not guarantee the quality, safety, legality or accuracy of any listing.
- We are not responsible for delivery, fulfilment, returns, warranties, refunds or disputes between users.
An order or a booking made here is a request sent to a business. Payment, delivery and everything else is arranged directly between you and them, outside this platform, and is governed by whatever you agree with each other. If something goes wrong, your counterparty is the business - not us.
Our business model is a subscription to a publishing platform. It is not a commission on your sales, and we take no part in them.
4 Your account
Accuracy. Give us accurate information when you register and keep it up to date. A business profile must represent a real business.
Security. You are responsible for your password and for everything done through your account. Tell us immediately if you think someone else has access to it. We strongly recommend turning on two-factor authentication.
One account each. One person or business, one account. Additional accounts created to evade a restriction, inflate engagement or impersonate someone will be removed.
Impersonation. Do not present yourself as a person or business you are not.
5 Your content stays yours
You keep ownership of everything you upload or publish - posts, images, articles, listings, logos, descriptions, reviews and comments.
To be able to run the service at all, we need your permission to handle that content technically. You therefore grant us a non-exclusive, worldwide, royalty-free licence to store it, back it up, resize and re-encode images, generate thumbnails, and display and deliver it through the platform and its content delivery network to the people you have published it to.
That licence exists only so the service can work. It does not let us sell your content, license it to anyone else, or use it in advertising without asking you first. It ends when you delete the content, except for copies sitting in encrypted backups until they roll over.
You are responsible for what you publish. You confirm that you have the rights to it and that publishing it here breaks no law and no one else's rights.
6 What you may not do
The full list lives in our Community Guidelines, which form part of these terms. In summary, do not publish content that is illegal, fraudulent, infringing, hateful, threatening, sexually explicit, or deliberately misleading, and do not use the platform to spam, scrape, impersonate, attack our systems, evade a ban or manipulate what gets seen.
7 Moderation, and your right to challenge it
We review content that is reported to us, and we may review content proactively using both automated checks and human moderators.
Where something breaks these terms we may hide it, remove it, restrict a feature on the account, suspend the account, or in serious or repeated cases close it permanently. We may also cooperate with law enforcement where we are legally required to.
When we act against you, we will tell you what we did and why, in your account. You can appeal that decision once, from the same screen, and a person will look at it again. If we got it wrong, the decision is reversed.
If you report something, we will tell you the outcome.
8 Subscriptions and payment
Paid plans are billed monthly in advance and renew automatically until you cancel. You can cancel at any time from Settings, in one step, with no need to contact us. Cancelling stops the next charge and leaves your plan running until the end of the period you have already paid for.
Full details - prices, renewal, failed payments, what changes when a plan ends - are in the Subscription & Billing Policy, and your refund rights are in the Refund & Cancellation Policy. Both form part of these terms.
Payments are processed by Stripe. We never see or store your card number.
9 Closing your account
You can close your account at any time from Settings. Your profile and everything you published comes down immediately, and any subscription is cancelled.
For 30 days you can undo it simply by signing back in. After that your personal data is permanently erased or anonymised. Some records survive: invoices, because accounting law requires it, and orders and bookings you placed, because they are the other business's records - with your account no longer attached to them.
We may suspend or close an account that seriously or repeatedly breaks these terms, or where we are legally required to. Except where that would be unlawful or would defeat the purpose, we will tell you why and you may appeal.
10 Our intellectual property
The BoothPost name, logo, design and software are ours. Using the service does not give you any right to copy, modify or redistribute them.
11 Availability, warranties and liability
We work to keep the service running, but we do not promise it will be uninterrupted or error-free. It is provided as it is.
To the fullest extent the law allows, we are not liable for indirect or consequential loss, for lost profits or lost data, or for anything arising out of a dealing between you and another user. Where we are liable, our total liability in any twelve-month period is limited to what you paid us in that period.
Nothing here limits liability that cannot lawfully be limited - including for death or personal injury caused by negligence, for fraud, or for your rights as a consumer under the mandatory law of the country you live in.
12 Changes to these terms
This page carries a version number and an effective date, and earlier versions are kept so that what you agreed to can always be established.
Minor changes are published here. For material changes we will notify you and ask you to accept the new version before you continue using the service. If you do not want to accept it, you can close your account, and we will refund the unused part of any period you have paid for.
13 Governing law and disputes
These terms are governed by the law of North Macedonia, and its courts have jurisdiction.
If you are a consumer resident in the European Union, this does not deprive you of the protection of the mandatory law of your own country, and you may bring proceedings there.
Please contact us first. Most things are resolved faster by email than by anything else.
